A Update on This Year’s EEO-1 Filing
Get ready for EEO-1 Reports! While there have been rumors of the EEO-1 Report being cancelled or moved to the fall for this year, the Equal Employment Opportunity Commission (EEOC) has reportedly submitted its proposed 2024 EEO-1 instruction booklet to the Office of Management and Budget for review. If approved, companies with 100 or more employees will need to begin filing their EEO-1 reports this spring. Based on the submitted information to OMB, the EEO-1 portal is slated to open on May 20, 2025 and all reports must be filed by June 24, 2025 for companies to remain in compliance.
Update on Gender Identification:
The proposed instruction booklet was submitted with a request to eliminate non-binary submissions within the EEO-1 Report, to comply with Executive Order 14168, “Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.” While non-binary was not previously included as a listed gender within the form itself, companies were instructed to include employees who identify as non-binary within the comments section of the EEO-1 report. If approved, companies will now be required to represent their non-binary employees within only the Male and Female options on the form.
Confusion for Federal Contractors:
Interestingly enough, the new proposed booklet does still refer to Executive Order 11246 within its requirement guideline for federal contractors. Under the now rescinded Executive Order, the minimum employee headcount was lowered from 100 employees to require federal contractors with 50 or more employees to file the EEO-1 report. However, with the revocation of Executive Order 11246, federal contractors with less than 100 employees may no longer need to submit EEO-1 reports. We hope this confusion will be resolved with the final booklet approval.
