What is the EEO-1 Report?
The EEO-1 is a mandatory annual report filed with the Equal Employment Opportunity Commission (EEOC), that requires employers to report on the racial/ethnic and gender composition of their workforce by specific job categories. The requirement to file is mandated by: Section 709(c) of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. 2000e, et seq., and Sections 1602.7-1602.14, Chapter XIV, Title 29 of the Code of Federal Regulations (CFR); Exec. Order No. 11246, 30 FR 12319 (Sept. 24, 1965) and 41 CFR 60-1.7(a).
Who needs to file?
The EEOC requires all private sector employers with 100 or more employees, and federal government contractors and subcontractors with 50 or more employees and at least $50,000 in contracts must file the EEO-1 data reports.
What happens if you do not file?
Federal contractors and subcontractors who are required to file an EEO-1 report but fail to do will not be fined, but may result in a court order or other serious repercussions including an enforcement audit with a Conciliation Agreement. This can put a company under increased scrutiny with OFCCP and the EEOC moving forward.
