OFCCP Invites Federal Contractors to Volunteer Information

In a letter dated June 27, 2025, OFCCP Director Catherine Eschbach has invited federal contractors to participate in the voluntary submission of a narrative describing how they have wound down their women & minority affirmative action efforts based on the now rescinded Executive Order 11246.

The letter reads: “In considering what information they may want to provide, federal contractors should examine their previous affirmative action plans or efforts they had undertaken in response to OFCCP’s prior regulatory requirements.  For example, federal contractors who used placement goals for certain job groups based on race or sex may wish to provide information demonstrating that they have discontinued these practices. Similarly, federal contractors who as part of their affirmative action efforts had been providing certain employment opportunities or undertaking recruitment efforts based on race or sex may wish to provide information reflecting the discontinuation of these practices.”

It's important to note that while this letter outlines examples of what kind of information could be included in a narrative, it does not explain how this information may be used, who it might be shared with, or even whether or not it could be used to investigate a contractor who previously used employment practices now considered illegal.

OFCCP is accepting these voluntary submission for 90 days, instructions on how to submit any volunteered information will be available on the reinstated OFCCP Contractor Portal.
