OFCCP Seeks Reauthorization to Enforce VEVRAA

On January 7, 2026, the OFCCP published a request to seek reauthorization to enforce the Vietnam Era Veterans' Readjustment Assistance Act (VEVRAA) recordkeeping requirements for federal contractors. Due to the Paperwork Reduction Act, federal agencies must get approval every three years for the financial and time dedication burden of any reports or records that they require. In this case, the regulatory approval for the information collection required to enforce VEVRAA is set to expire on April 30, 2026, and if renewed, the authorization for OFCCP to continue enforcing VEVRAA will be extended to April 30, 2029.

In the federal budget package for fiscal year 2026, OFCCP is earmarked to be fully funded in 2026. This recent development, coupled with a number of other administrative updates for OFCCP, indicates that the OFCCP will continue to have oversight of federal contractor affirmative action obligations for veterans and individuals with disabilities in 2026.

What This Means for Your Company: 

This renewal request highlights OFCCP’s intention to continue enforcing and extend federal contractor veterans affirmative action obligations. To remain in compliance with VEVRAA, we recommend that federal contractors should continue to do the following: 

  • Continue to invite applicants and new hires to self-identify as a protected veteran 

  • Periodically survey your employees and invite them to self-identify as a protected veteran

  • Develop annual affirmative action plans for protected veterans

  • Analyze the effectiveness of your outreach efforts for protected veterans annually

  • ·List all job openings with the required state or local ESDS

 While the recent renewal is focused on data collection for VEVRAA, contractors should also continue to prepare annual affirmative action plans for individuals with disabilities, as required, and continue to invite their applicants and employees to self-identify as an individual with a disability.
